Terms and Conditions
Welcome to AmazingBaby.store (the "Platform"). These terms and conditions ("Terms") apply to the use of the Platform, including the purchase of products through the Platform. By accessing and using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use the Platform.
1. Platform Usage
1.1. The Platform is owned and operated by AmazingBaby E Commerce Owned By APMO Company.
1.2. You must be at least 18 years old to use the Platform. By using the Platform and agreeing to these Terms, you represent and warrant that you are at least 18 years of age.
1.3. You agree to use the Platform in accordance with all applicable laws and regulations.
2. Product Purchases
2.1. By placing an order through the Platform, you warrant that you are legally capable of entering into binding contracts.
2.2. When you place an order through the Platform, you are offering to buy the product at the price stated, subject to these Terms.
2.3. After placing an order, you will receive an email from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a product. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an email that confirms that the product has been dispatched (the "Dispatch Confirmation"). The contract between us will only be formed when we send you the Dispatch Confirmation.
2.4. If we are unable to supply you with a product, for example because that product is not in stock or no longer available, or because of an error in the price on our Platform, we will inform you of this by email and we will not process your order. If you have already paid for the products, we will refund you the full amount as soon as possible.
3. Pricing and Payment
3.1. The prices of products are as stated on the Platform and are subject to change without notice.
3.2. Payment for all orders must be made at the time of placing the order through the Platform. We accept various methods of payment, and details of acceptable payment methods are provided on the Platform.
3.3. By providing the details of a credit or debit card, you confirm that the payment details provided are valid and correct. All credit/debit cardholders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to us, we will not be liable for any delay or non-delivery.
4. Delivery
4.1. We will deliver products to the delivery address provided by you in your order. We will use reasonable endeavors to deliver products on or before the date for delivery set out in the Dispatch Confirmation or, if no date is set out in the Dispatch Confirmation, within a reasonable time.
4.2. We are not responsible for any delay in delivery caused by the unavailability of someone to take delivery of the products. It is your responsibility to contact the post office or courier company as applicable to arrange the collection or delivery of products that could not be delivered because you were unavailable.
5. Returns and Refunds
5.1. If you are not satisfied with a product you have purchased, you may return the product to us for a refund or exchange. Please refer to our Return Policy for more information on returns and refunds.
6. Intellectual Property
6.1. All intellectual property rights in the Platform and the material published on it are owned by or licensed to us. These works are protected by copyright laws and treaties around the world. All such rights are reserved.
6.2. You may print off one copy, and may download extracts, of any page(s) from the Platform for your personal use and you may draw the attention of others within your organization to content posted on the Platform.
6.3. You must not use any part of the content on the Platform for commercial purposes without obtaining a license to do so from us or our licensors.
7. Limitation of Liability
7.1. Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by Egyptian law.
7.2. To the extent permitted by law, we exclude all conditions, warranties, representations, or other terms which may apply to the Platform or any content on it, whether express or implied.
7.3. We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with use of, or inability to use, the Platform or use of or reliance on any content displayed on the Platform.
8. General
8.1. We may revise these Terms at any time by amending this page. You are expectedto check this page from time to time to take notice of any changes we made, as they are binding on you.
8.2. These Terms are governed by and construed in accordance with the laws of Egypt. Disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Egypt.
8.3. If any provision of these Terms is deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
8.4. No waiver by us of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure by us to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
8.5. These Terms, and any document expressly referred to in them, represent the entire agreement between us in relation to the subject matter of any contract and supersede any prior agreement, understanding, or arrangement between us, whether oral or in writing.
